Mundwerk – Terms of Use
1. Provider and scope
These terms of use apply to the “Mundwerk” app. The provider is Oliver Schmidt, Römerstr. 21-1, 71404 Korb, Germany, email: oliver.schmidt86@gmail.com. The basic features are free of charge and financed by advertising. There are also paid services (Mundwerk Plus, PDF without watermark, printed books and calendars).
2. Minimum age and account
You may only create an account if you are at least 16 years old. Your details must be true, and you may only use one account. Display names must not be offensive or impersonate other people.
3. What you may share
Mundwerk is a collection of funny and endearing things children say. Only share sayings with the community that a child you know really said. To protect children:
- no full names, addresses, names of daycare centres or schools, or other details that could identify a child,
- no content that exposes or ridicules a child or shows them in an intimate situation,
- no sexualised, offensive, discriminatory or violent content,
- no sayings copied from books, websites or other apps,
- no advertising, no spam, no links.
4. Publication and moderation
For every saying, you decide whether it is only stored in your private diary or shared anonymously with the community. Shared sayings appear immediately without prior review. Reported sayings are reviewed by the provider; sayings reported by several users are hidden automatically until reviewed. There is no right to publication.
5. Your content
You keep the rights to your content. You grant the provider the simple, free right to display your published sayings and comments in the app, store them for this purpose and allow them to be passed on via the share function. You can delete your own sayings and comments at any time.
6. Reporting and moderation
You can report violations via “Report”. The provider may remove content that violates these terms or the law without notice. In the event of serious or repeated violations, an account may be blocked.
7. Mundwerk Plus and in-app purchases
Mundwerk Plus is a subscription for one family: one person subscribes, and all members of the family the subscription is assigned to can use the Plus features (including voice recordings, all designs, 4 PDFs without watermark per 12 months, 10 % off print products, no ads). The scope is shown in the app before purchase.
You buy the subscription and single PDFs via Google Play or the Apple App Store. The respective store is the contractual partner for payment; its terms apply, including for refunds. The subscription renews automatically for the chosen period (month or year) unless you cancel it at least 24 hours before it ends in your store account's subscription settings. A free trial turns into a paid subscription unless cancelled.
When the subscription ends, all content is kept and remains visible, including voice recordings. New Plus content can no longer be created. If the paying person leaves the family, Plus ends for the other members.
8. Availability and liability
The provider strives for smooth operation but cannot guarantee constant availability. The provider is fully liable for intent and gross negligence and for injury to life, body or health; for slight negligence only in the event of a breach of essential obligations and limited to foreseeable damage. The provider is not responsible for other users’ content but removes unlawful content as soon as it becomes aware of it.
9. Termination
You can delete your account at any time in the app under “Settings” (gear icon, top right) → “Delete account”.
10. Changes and final provisions
You will be informed in the app about material changes to these terms and asked for your consent. German law applies; mandatory consumer protection provisions of your country of residence in the EU remain unaffected.
